General Conditions of Sale

The general conditions of sale described in this document regulate the sale of products made by the Seller, Mulino Padano S.p.A., registered office in via C. Battisti n. 1, 45030 – Ceneselli (RO) ITALY, VAT number 00964980296, R.E.A. n. 106227, through access by the Customer to the store.mulinopadano.it site, and are an integral and essential part of the sales contract. The Customer is required to read the general conditions of online sale, before completing the purchase procedure. The placing of an order implies full knowledge and full acceptance of the same.

The sales contract is confirmed on acceptance of the Order

The Order is the proposal to purchase one or more Products, made by the customer completing the order form and forwarding it to the Seller. The Customer, by accepting this contract, declares to have adequate knowledge of the goods ordered and the related warranty conditions, the price, the conditions of sale and the methods of delivery of the goods. Following the placing of the order by the customer, the contract is confirmed by the Seller sending an email containing the express acceptance of the order in total or in part. In the event that the Order is only partially accepted, or rejected, the Seller undertakes to communicate as soon as possible (and in any case within 10 working days) with the Customer and, at the same time, to reimburse the sum committed by the Customer via bank transfer.

Customer Obligations

The Customer undertakes to read and keep a hard copy of the General Conditions. It is strictly forbidden for minors to conclude an order online. It is strictly forbidden to enter false and / or invented data, or data of third parties in the registration procedure necessary to activate the execution of the Contract.

Product Characteristics 

The Customer, upon purchase, may only request products shown on the site at the time of ordering. The Seller reserves the right to change the range, characteristics and information supplied with the Products without prior notice. The images shown with the description of the individual products may not be perfectly representative and differ in colour and size. Since the illustrations on the site are illustrative, the Seller is not responsible for any inadequacy of the same.

Product Prices 

The sales prices displayed on store.mulinopadano.it include VAT. The Seller reserves the right to change prices and / or offers introduced, at any time, without prior notice and with immediate effect. The prices shown do not include delivery costs, which will be displayed and calculated separately before the completion of the Order.

Product Shipment and Customer’s charges

Mulino Padano S.p.A. will entrust the shipment to a trusted courier. The Products will be delivered to the address indicated and shipping will take place within seven working days of ordering. No responsibility can be attributed to Mulino Padano for delays or non-delivery due to extenuating or unforeseeable circumstances. The delivery terms are indicative and subject to circumstances that may preclude, hinder and delay the normal procurement and production process and therefore the delivery of the goods. Delivery costs are quantified with reference to delivery to the external street number, not to the floor or internal number indicated. Any ancillary charges arising from storage costs accrued due to the impossibility of delivery to the Customer, due to the absence of the latter, is expressly excluded from this contract.

At the time of delivery, the Customer is required to check that the number of packages delivered corresponds to that indicated on the invoice and that the packaging is intact. Any variation in the packages from that declared on the invoice and / or damage to the packaging must immediately be reported to the Carrier. The Customer is required to refuse the delivery and inform the Seller as soon as possible by sending an e-mail to info@mulinopadano.it, and attaching any relevant photos.

Responsability

Mulino Padano S.p.A. assumes no responsibility for inefficiency attributable to extenuating circumstances. It will not be liable to any party for damages, losses and costs incurred as a result of the non-execution of the contract, as the Customer is only entitled to a refund of the price paid. Furthermore, Mulino Padano S.p.A. cannot be held responsible for any fraudulent or illegal use, that may be made by third parties, of the Customer’s credit cards as at no time during the purchase process is the Seller party to any information relating to the Customer’s credit card. This information is transmitted via secure connection directly to the banking service.

Billing

The Seller issues a regular invoice upon delivery of the products ordered by the Customer, to the courier. The amounts indicated on the invoice include the gross price of the Products and delivery costs, excluding any charges and / or taxes due by law. The Customer absolves the Seller from any liability deriving from the issue of incorrect invoices due to errors in the data provided by the Customer, who assumes sole responsibility for the correct entry of the same. No changes are possible after the document has been issued.

Terms of payment

The Customer can choose between the following payment methods accepted by the Seller:

  • PayPal
  • Credit Card – Visa, Mastercard and prepaid cards;
  • Bank transfer to the Seller’s current account indicated at the time of payment.

Guarantees and product verification

Even if the packaging is intact, the customer is required to check the goods within seven days of the receipt of the same, under penalty of forfeiture. Any damage or hidden defect must be reported via email to info@mulinopadano.it. The Customer may then send the defective goods, at his own expense, to Mulino Padano S.p.A., Via C. Battisti n. 1 – 45030 – Ceneselli (RO) ITALY. In the event that Mulino Padano finds the defect, it will replace the items and credit the shipping costs, while it reserves the right to charge the customer the costs of checking and returning the product, if it is found to be free of defects.

Right of withdrawal 

(D. Lgs. N°206 of the 6 September 2005 – consumer code)

The Customer has the right to withdraw from the contract by registered letter to be sent to the Seller’s office – Via C. Battisti n. 1 – 45030 – Ceneselli (RO) ITALY – and then proceed to return the goods. The withdrawal will only be put into effect if exercised within ten working days of signing the order. It is advisable to attach a photocopy of the order to the registered letter. The Customer must return the product, at his own expense, within 15 working days of the receipt of the product. All items must be returned intact, with their original packaging and any other material that is part of the package. In the event of withdrawal, Mulino Padano is required to fully refund the price of the product within the terms of the law (30 days).

Conclusion 

Failure to pay on the respective deadlines, or failure to comply with other obligations assumed by the Customer, will entitle the Seller to consider the contract null and void due to the fault of the Customer.

Disputes

The Court of Rovigo (ITALY) will be exclusively responsible in any dispute. The General Conditions of Sale are understood to be accepted in full by the Customer, who renounces any of his own purchase conditions, considered individually or as a whole.

Treatment of personal data

Pursuant to Regulation (EU) 2016/679 (GDPR) concerning the protection of personal data, Mulino Padano S.p.A. specifies that:

  • The personal data provided in the ordering phases will be kept for the time required by law at the Company’s headquarters, on computer media protected by passwords, and used only for the purposes of administration, archiving, processing and documentation of commercial activity;
  • The provision of personal data is strictly necessary for the purpose of concluding the following contract and for future commercial relations between the parties;
  • Any interested party can exercise the rights referred to in articles 7, 8 and 9 of Decree 196 of 2003;
  • Data processing takes place using tools able to guarantee security and confidentiality in accordance with the Technical Regulations regarding minimum security measures with controlled access limited to authorized subjects;
